A trans Transportation Security Administration (TSA) officer has filed a federal lawsuit against Kristi Noem after an executive order prevented her from doing an important part of her job.
Vocal opponent of LGBTQ+ rights, Kristi Noem, saw her loyalty to Trump rewarded when she was appointed to serve as the secretary of the Department of Homeland Security.
Danielle Mittereder has worked for the TSA screening passengers at Dulles International Airport since last year. However, in her lawsuit, she claims Donald Trump’s executive order – “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government” – has made it impossible for her to perform her duties.
The order, signed by Trump and enforced by Noem, discriminates against trans federal employees by blocking them from key parts of their roles.
Her attorney told The Independent: “She’s good at her job, she wants to go to work and do her job everyday. And she’s not allowed to do it, for the sole reason that she is transgender.”
The complaint states: “As a result of Defendant’s discrimination, [Mittereder] suffered and continues to suffer anxiety, depression, fear, feelings of uncertainty, crying spells, grief, and low mood. [She] experienced and continues to experience anger, frustration, embarrassment, and humiliation as a result of Defendant’s decision to prohibit her from doing much of her job, single her out, and stigmatise her due to her gender identity.”
In the lawsuit, Mittereder named Noem as the lone defendant.
A TSA spokesperson confirmed in an email that as a result of the executive order, male officers conduct pat-downs on male passengers, while female officers conduct pat-downs on female passengers.

Noem previously described marriage as “a special bond between a man and a woman”. In early 2022, she signed a bill banning trans student-athletes from playing in sports leagues that align with their gender identity, saying it would “ensure that we have fairness and a level playing field” in the Mount Rushmore State.
She was also responsible for an anti-trans ad promoting her re-election campaign in 2022, which activists labelled “discriminatory rhetoric”.
